INOVIO Pharmaceuticals, a Plymouth Meeting, Pennsylvania-based biotechnology company developing DNA medicines for HPV-related diseases, cancer, and infectious diseases, has prevailed in its six-year legal dispute with a former manufacturing partner. The company announced on October 20, 2026 that the Court of Common Pleas of Montgomery County, Pennsylvania, entered judgment in its favor on all claims against VGXI, Inc. and GeneOne Life Science, Inc.
Inside the Ruling
The court awarded INOVIO about $61.8 million in compensatory damages and $18.7 million in fees and costs, for a total judgment of $80.4 million. It also ruled against the defendants on their counterclaims.
INOVIO filed the suit on June 3, 2020. The company alleged that VGXI and GeneOne breached the parties’ Supply Agreement by refusing to honor technology transfer obligations meant to enable scalable manufacturing of DNA plasmids.
Collecting the Award
INOVIO cautioned that the defendants’ financial condition will likely make it difficult to collect some or all of the judgment. The company says it intends to make every reasonable effort to recover the damages.
Cooley LLP and FBT Gibbons served as INOVIO’s trial counsel.
